USER AGREEMENT

TERMS OF SERVICE

1. GENERAL PROVISIONS AND TERMS

• Platform — Litbuk.club website and/or associated mobile application providing access to E-books and Audiobooks.
• The Platform sells digital content worldwide, with the exception of the Russian Federation, due to technical and operational limitations of the payment gateway. Cards issued by Russian banks are not accepted for payment.
• Content — Audiobooks, E-books (ePub, fb2, pdf, etc. formats), text fragments, covers, and other materials posted on the Platform.
• User – an individual who, at the time of registration on the Platform, has reached the age for which the relevant Content is intended, has registered on the Platform and/or made a payment for any access to the Content, has downloaded and/or started using the Subscription or any other services offered through the Platform.
• PPD (Pay-Per-Download) is a one-time purchase model in which the User pays for access to a specific unit of Content for downloading or unlimited listening/reading in their personal account.
• Subscription is a model for providing access to the Content catalog for a limited period (month, six months, year) on the terms of regular, automatically renewing payments.
• "Club Card" is a Content access mode that, for a one-time, non-cash fee, allows the User to download and/or view one or more units of Content of the User's choice at a price reduced from the price set on the Website for Users who do not use the "Club Card" mode. The "Club Card" mode may also provide access to Content not available to Users who do not use the "Club Card" mode.

2. APPLICABLE LAW AND JURISDICTION

• This Agreement shall be governed by and construed in accordance with the laws of the State of Israel, including the Copyright Law (2007) and the Consumer Protection Law (1981), without regard to its conflict of law provisions.
• All disputes arising out of this Agreement or the use of the Platform shall be subject to exclusive jurisdiction in the competent courts of Jerusalem, Israel.
• If the User accesses the Platform from countries outside of Israel, he/she is solely responsible for compliance with the local laws of his/her jurisdiction.

3. TERMS OF USE AND COPYRIGHT

• All Content in Russian is provided to Users on the basis of legal license agreements with copyright holders (authors and publishers).
• The Platform grants the User a non-exclusive, non-transferable, revocable license for personal, non-commercial use of the Content.
• The user is strictly prohibited from:
• Copying, distributing, translating, publicly performing, reselling, or transferring Content to third parties (including uploading to torrents, Telegram channels, or social networks).
• Circumventing any digital rights management (DRM) or other restrictions imposed by the Platform.
• Using Content to train artificial intelligence (AI) systems, large language models (LLM), and neural networks.

4. PAYMENT TERMS AND RECURRENT PAYMENTS

• Prices for Content (PPD) and Subscription are indicated on the Platform in US dollars (USD) or Israeli new shekels (ILS), depending on the User’s geolocation.
• For the Subscription and "Club Card" models: Payment is debited automatically (auto-renewal) at the beginning of each billing period (month, six months, or year). The User can cancel the Subscription at any time through the Personal Account settings. Access to the catalog remains until the end of the paid period.
• All payments on the Platform (both one-time PPD purchases and recurring Subscription payments) are processed by the authorized payment provider Allpay (Israel) in conjunction with licensed Israeli acquirers (Isracard, CAL, etc.). Users can pay with international bank cards (Visa, Mastercard, American Express, Diners, JCB), as well as through Apple Pay express methods and the Israeli payment system Bit.
• All transactions are processed through certified international payment gateways (PCI-DSS). The Platform does not store Users' bank card details.

5. CANCELLATION AND REFUND POLICY

• In accordance with the Israeli Consumer Protection Law (1981) and international practice regarding digital goods, digital Content of adequate quality is not subject to return or exchange after the User has been granted access to download (for PPD) or to playback the catalog (for Subscription).
• By clicking the "Pay," "Download," or "Listen" button, the User confirms their explicit consent to the immediate execution of the contract and terminates their right to refuse the digital product.
• Refunds for a Subscription for a billing period that has already begun and been paid for are not provided. If a renewal charge is erroneous due to a technical error on the Platform, the User has the right to contact support within 14 days.

6. TAXATION AND VAT

• Buyers who are residents of the State of Israel are subject to value added tax (VAT) at the standard government rate of 18%, which is automatically included in the final price of the goods on the receipt and on the Allpay payment page.
• For international buyers (outside Israel), Israeli VAT is 0%. However, the User is solely responsible for paying any local taxes, duties, or digital services taxes (e.g., VAT in the EU, Sales Tax in the US), if applicable by law in their country.
• After any successful transaction (PPD or Subscription debit) is completed, the system automatically generates an official digital tax document/receipt (Kabalat / Heshbonit Mas), which complies with the requirements of the Israel Tax Authority. The document is sent to the User's email address specified during payment, in English or Hebrew (via Allpay's integration with the licensed EasyCount service).

7. TAKEDOWN POLICY

• If you are a copyright holder and discover that your content has been posted on the Platform without permission, please send an official complaint to the email address: support@litbuk.club.
• The complaint must include: evidence of your rights to the content (contracts/patents), direct links to the infringing materials on the Platform, and your contact information. The Platform undertakes to promptly block access to the content during the investigation.

8. LIMITATION OF LIABILITY

• The platform is provided on an "as is" basis. We do not guarantee uninterrupted operation of the site in all regions of the world due to possible local restrictions by internet providers or blocking by third countries.
• The Platform's maximum aggregate liability to the User for any claims is limited to the amount actually paid by the User to the Platform over the last 3 (three) months.
